Labour Court recommends changes to Tesco worker’s warning, location and training

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court recommended changes to an anonymised Tesco Ireland Limited worker’s disciplinary warning, work location and training after his appeal. The recommendation was signed on 20 December 2016. It said the warning should expire in mid-January 2017 and should not be considered in future disciplinary matters. The worker, represented by Mandate Trade Union, said he was helping a neighbouring premises deal with a difficult young man and that the sanctions were severe. Tesco Ireland Limited said he had used excessive force and should not have left his post. The Court recommended that the parties agree a Dublin location as close as possible to Dolphin’s Barn, with weekly hours close to those in his former assignment. It also recommended that he be allowed to repeat PSA training and apply through the usual process for future RSO vacancies.
