The Labour Court recommended on 20 December 2016 that Tim Hastings Ltd offer its former Parts Manager a choice: take an advertised Motor Parts Advisor job on his pre-redundancy terms or accept an ex-gratia redundancy payment. The recommendation followed the union’s claims about redundancy selection and payment terms. The Court said it could not accept that the Parts Manager position was genuinely redundant, given the advertised full-time permanent job and lack of contrary information. For other positions genuinely made redundant, it recommended an ex-gratia payment of two weeks per year of service, in addition to statutory redundancy. The process included examination of the company’s financial position by the Services Industrial Professional Technical Union’s financial expert.
