The Labour Court recommended that Medite Europe Limited amend its sick-pay scheme to reflect the company’s interpretation of the 12-month review period. The recommendation was signed on 20 December 2007. The Services Industrial Professional Technical Union argued that the 12-month period should run forward from the start of an employee’s first sickness absence. The company reviewed the preceding 12 months and deducted sick leave already used. The Court agreed that the first recorded absence set the anniversary date for reviewing eligibility.
