In 1999, the Labour Court recommended that Smith Mc Laurin Limited apply its 1997 redundancy terms to Three Workers after deciding to close its Portlaoise operation. The recommendation was signed on 17 August 1999. The workers had sought six weeks' pay per year of service, £50 per year of service inclusive of statutory payment, no cap on payments and other terms. The company said losses and loans secured on its assets left it unable to improve its offer. The Court found that circumstances had not changed enough to justify departing from the terms previously applied.
