The Labour Court recommended Grade 2 pay from September 1995 for two employees of Blair Builders Limited Trading As Browne Construction Company. The recommendation was signed on 19 April 1996. The Services Industrial Professional Technical Union (SIPTU) sought promotion from Grade 3 to Grade 1, arguing the employees' duties supported the higher grade. The company said their work did not meet Grade 1 requirements and that their existing pay and conditions were more favourable than those in the registered agreement. The Court found that the employees' work and equipment were appropriate to Grade 2. It recommended the Grade 2 rate applicable from September 1995 and that they be available to carry out work within that grade.
