The Labour Court recommended that six storepersons at Penney's Tralee receive £2.50 an hour for their first year, followed by a pay scale pro-rata to shop assistants' pay. The recommendation was signed on 19 April 1996. Mandate had sought a rate on a par with shop assistants. Penney's Tralee argued that the storepersons' work differed and that their existing rate was fair compared with local rates. The Court also noted the company's policy of giving the workers preferential consideration for shop-assistant vacancies.
