The Labour Court recommended that disciplinary penalties expire for promotion purposes after 24 months in a dispute involving Wyeth Nutritionals Limited and the Services Industrial Professional Technical Union. The recommendation was signed on 5 December 1994. The Court found Wyeth’s promotion selection criteria were not unreasonable and noted that they recognised seniority. The union’s claims on shift-loss compensation and utility pool notice were not conceded. The Court said the agreement covered earnings lost through enforced shift changes, and other claimants had not established a loss of earnings.
