Labour Court backs Kelly's skills exception in redundancy selection

By Rory Hanlon

Place: no local area assigned from the source.

In 1994, the Labour Court recommended that Kelly's Limited exclude two workers with special skills from the last-in, first-out redundancy calculation. It also recommended redundancy payments for two essential redundancies at four times statutory redundancy plus the rebate. The company argued that the workers' skills were critical to the business, while Mandate sought last-in, first-out selection. The Court said the two workers had skills unavailable among the other sales staff, amid continuing trading difficulties. The recommendation was signed on 3 March 1994.
