In 1994, the Labour Court rejected an appeal by the Irish National Union of Vintners', Grocers' and Allied Trades Assistants against a Rights Commissioner's recommendation that Power Supermarkets had not acted unfairly in dismissing a worker. The Court's decision was signed on 3 March 1994, and the recommendation stood. The union argued that the employer had not shown the worker intentionally misled it on the job application. Power Supermarkets said the application left out information about an earlier accident and that a false or misleading declaration could lead to dismissal.
