The Labour Court found that County Cork Vec breached music teacher Hugh Rance’s fixed-term worker rights, awarding him €9,000 compensation and upholding a separate €5,000 training award. In its determination dated 1 December 2008, the Court also ruled he was entitled to a contract of indefinite duration from 26 August 2006, with applicable arrears of pay and pension. Rance had appealed a Rights Commissioner’s decision.
The Court found breaches over travel expenses, pay for Art teaching and holiday pay, but rejected Rance’s incremental-credit claim and found no breach over the rate paid for unqualified Music teaching. It found his complaint about written reasons for contract renewal was out of time; the merits were not decided. The VEC said it had been unable to establish Rance’s Music-teaching qualifications and was required to recruit qualified teachers.
