In 2008, the Labour Court recommended against the union’s claim for a 48-hour contract for a worker at Iarnrod Eireann. Its recommendation was dated 1 December 2008. The Services Industrial Professional Technical Union argued that the worker would have moved to a 48-hour contract but for a serious workplace accident and alleged disability discrimination. Iarnrod Eireann said the worker could no longer do his former duties, that it found him a more suitable position and that the 45-hour arrangement had been agreed with the union. The Court said the transfer and 45-hour contract had been agreed with the union and found no reasonable basis to improve those terms. It did not recommend the claim.
