In 2003, the Labour Court dismissed Mary Margetts’s complaint that Graham Anthony &Company Limited discriminated against her on grounds of age, marital status and family status at interview and during her employment, including in her dismissal. The determination was dated 7 August 2003.
Margetts said she sought full-time hours and was treated differently. The company said its decision was based on a poor reference, warnings and her complaints about hours. The Court found that the evidence did not establish the three grounds as factors in the dismissal. It said any unfairness in the dismissal process did not itself establish discrimination, and did not decide whether the dismissal was fair under employment law.
