The Labour Court has dismissed Rosalind Murray’s disability discrimination appeal against Institute Of Technology Carlow, upholding the Adjudication Officer’s decision. The determination was signed on 19 December 2024.
Murray alleged that the institute failed to arrange an occupational health assessment during the relevant period. The institute argued that she had not identified a disability-related breach or a colleague treated more favourably. The Court found she had identified neither a comparator nor an act during the relevant period linked to disability that could amount to less favourable treatment. It found no prima facie case, so the complaint failed.
