The Labour Court has upheld a decision rejecting Liam Drennan’s public holiday pay complaint against Bausch Health Ireland Limited T/A Bausch and Lomb. The determination is dated 29 April 2024. Drennan argued that pay for shifts partly outside a public holiday should include extra hours, and that regular overtime should count when calculating pay for a holiday he did not work. The company said its calculations complied with the regulations. The Court found that Drennan received more than the required rate for holidays he worked and the correct payment for a holiday he did not work. It found no financial or other detriment, and said the additional payments he sought were not provided for in the legislation or regulations.
