The Labour Court allowed John O Donnell’s appeal and awarded him £1,500 after finding Wolf Security had failed to provide paid annual leave. Its determination was dated 20 December 2000. The Rights Commissioner had dismissed O Donnell’s complaint after he failed to attend the hearing. The Court extended the time limit for reasonable cause and considered only leave due in the 18 months before 21 August 2000. It found that an enhanced hourly rate could not replace paid leave: O Donnell received no pay increase for holidays and never took leave. The Court said the arrangement could discourage workers from taking holidays and held the contract clause waiving holiday pay void insofar as it conflicted with the Act.
