The Workplace Relations Commission found two complaints by Anthony O'Sullivan against Bidvest Noonan (ROI) Limited not well-founded in a decision dated 13 March 2025. O'Sullivan said his job title and terms changed after his employment transferred from O.C.S. to the company in 2023. Bidvest Noonan denied breaching the law and said he signed a form describing his job title as Cleaner Operative. The respondent accepted that form did not meet the legal requirements for a written statement of employment particulars. The adjudicator found there was insufficient evidence to establish whether O.C.S. held other documentation that could qualify as a statement, so the claims could not be upheld as presented. The decision did not determine whether the alleged contractual changes were lawful, as that issue was outside the adjudicator’s jurisdiction.
