The Workplace Relations Commission (WRC) dismissed Thomas Delecolle’s complaint against Apple Distribution International Limited under the Protection of Employees (Fixed-Term Work) Act 2003. The decision was dated 13 March 2025. Delecolle alleged that after WRC mediation failed, the company penalised him with an unfair performance plan designed to make him fail. The company argued the Act applied only to fixed-term employees. Delecolle accepted that he was a permanent employee and that the mediation and hearing involved no related matter covered by the Act. The adjudicator found the complaint misconceived and bound to fail, and dismissed it. No award was recorded.
