The Workplace Relations Commission found Coleen Malcolm was unfairly dismissed from her night-porter job at Glenties Hospitality Ltd Glenties Hospitality Ltd and ordered €23,000 compensation. The decision was dated 21 February 2024.
Malcolm said proprietor Pat Rice dismissed her after a dispute at the hotel door and escorted her out. The respondent denied dismissing her and pointed to performance concerns and warnings.
The adjudication officer found that Malcolm’s messages made clear she believed she had been dismissed, and the employer should have clarified any misunderstanding. The officer gave no weight to warnings because no disciplinary process preceded them, finding the written warning was issued retrospectively to address the dismissal.
The €23,000 compensation was based on 104 weeks and 24 weekly working hours.
