The Workplace Relations Commission found all four of Thomas O’Regan’s complaints against Tullow Day Care Centre CLG were not well-founded, including his constructive dismissal claim. The decision was dated 14 February 2024. O’Regan, who worked as a driver until December 2022, complained about a replacement employment contract, daily rest breaks and his resignation. He said he was unhappy with the new contract and sometimes could not take his statutory break during dinner runs. The centre said the replacement contract reflected his existing terms and its time sheets showed he received breaks. The WRC found the replacement contract reflected his actual terms, and O’Regan had not identified missed breaks within the relevant period. It also found he had not established that his resignation was involuntary or that the centre’s conduct justified it; he had not fully engaged with its grievance process before resigning.
