The Workplace Relations Commission rejected John Gleeson’s disability discrimination complaint against the Property Registration Authority, finding he had not provided enough medical information for the employer to understand his condition and consider accommodation. The decision was dated 14 February 2024.
Gleeson said migraines became more severe and frequent after a photocopier was placed near his desk, and that the employer did not adequately accommodate him. The Authority denied discrimination and said it needed medical information to assess his accommodation needs.
The adjudicator accepted that Gleeson suffered debilitating headaches, but found he had not provided information that could help the employer understand his condition and what adjustments might help. The Authority had offered an alternative office, which Gleeson declined; the adjudicator also noted that remote work was unavailable in that office. Victimisation and harassment claims were unsupported by evidence.
