The Workplace Relations Commission found Megan Wrenn’s complaint against Seán Fagan Wholesale not well founded, in a decision dated 25 September 2023. Wrenn said she was treated unfairly when dismissed after working as a receptionist and office administrator on a contract covering an employee’s maternity leave. She had selected the Terms of Employment (Information) Act 1994, but the adjudicator said her complaint appeared to concern unfair dismissal and could be brought under the Industrial Relations Act 1969. Wrenn said she had received a statement of her terms and conditions. The complaint under the Terms of Employment Act was found not well founded because it was brought under the wrong Act; the merits of any unfair dismissal claim under the Industrial Relations Act were not determined.
