WRC rejects four claims against HSE by agency worker

The Workplace Relations Commission found four claims brought by agency worker Lourda Finn against the Health Service Executive could not succeed. The decision was dated 10 April 2024. Finn worked as a Grade III clerical officer in the paediatric department at University Hospital Dooradoyle in Limerick through an agency. She claimed the HSE had failed to provide written employment terms, give minimum notice, keep working-hours records and provide equal treatment under agency-worker rules. The adjudicator found Finn was employed by the agency, which had provided her with an agreement and paid her through the notice period. The HSE therefore had no duty to provide a separate terms statement, give notice or keep her hours records. Her claims about Grade IV pay and overtime fell outside the relevant time period, and she did not establish that she had been penalised for raising concerns. All four claims were found not well founded or misconceived in law.
