The Workplace Relations Commission found that Metropolitan Films International Limited unfairly dismissed David Brady and awarded him €7,247.48 in compensation for loss of earnings. The WRC also found the company breached rules on employment terms, working hours, annual leave and notice.

Adjudication Officer Catherine Byrne’s decision was dated 20 February 2024. Brady worked for the company from 2015 across multiple productions and was dismissed in August 2021. The WRC found he was an employee of Metropolitan Films International Limited, despite being assigned to associated production companies, and that the company had not given him a written statement naming his correct employer.

The WRC awarded €7,247.48 for the failure to provide the correct employment statement, €5,000 for exceeding the average 48-hour weekly limit and €5,000 for breaches of annual leave rules. It found Brady had been paid for all leave due, but the company had not permitted leave during production or consulted him about its timing. The unfair dismissal award was equivalent to four weeks’ pay and was subject to tax, PRSI and USC deductions. He also received €7,247.48 in lieu of four weeks’ notice.

A separate Payment of Wages complaint was outside the time limit, so the WRC had no jurisdiction to hear it; the merits were not decided.
