The Workplace Relations Commission disallowed Grazyna Kaczynska’s appeal for a redundancy payment from Boston Scientific Ltd, finding she had not been dismissed by reason of redundancy. The decision was dated 12 May 2025. Kaczynska said duties she performed in quality support were reassigned while she was on leave, and the Product Builder roles offered for her return lacked the flexibility and status of her previous work. The company said her contract remained for a Product Builder role and that roles were available. The adjudication officer found that Kaczynska’s contract had always been for a Product Builder role. The employer had accommodated her request for flexible hours by assigning standalone tasks, and the reassignment of duties during her extended absence did not mean there was no role available. The officer also found no evidence that Kaczynska had been dismissed or that her contractual pay, hours or grade had been reduced. She was therefore not entitled to a redundancy payment.
