The Workplace Relations Commission found Linda MacDonald was entitled to statutory redundancy pay after the bakery where she worked closed, and awarded her €1,732.50 for not receiving written employment terms. The WRC decision was dated 27 October 2023.
MacDonald worked as a baker for The Yellow Phoenix Limited. She sought redundancy pay after the closure and said she had not received written terms or had wages unlawfully deducted. The company argued that suitable alternative work was available.
The WRC found the proposed alternative work would not begin within the required period, so MacDonald qualified for statutory redundancy pay, subject to the relevant insurable-employment condition. It found the terms complaint well-founded and awarded compensation equal to three weeks’ remuneration. The decision did not specify the redundancy payment amount. Both wage complaints were found not well-founded; the WRC did not extend the time limit for one because reasonable cause for the delay was not established.
