The Workplace Relations Commission found Shauna O'Neill’s unfair dismissal complaint against the Health Service Executive HSE Drogheda Services for Older People not well founded. The adjudication officer found that her employment had not ended. The decision, dated 1 November 2023, concerned O'Neill’s claim that she was constructively dismissed from the HSE Elder Care Service. She said she was told to leave an office after a meeting and have no further contact with staff or patients. The HSE said there had been no dismissal or break in service. The officer found that O'Neill began a Grade IV promotion post in Ardee shortly after the meeting, with no clear break in her employment. The complaint failed because there had been no termination of her employment contract.
