The WRC awarded Pauric Smyth €2,000 against An Post Postal Services for failing to provide a written statement of his employment terms. Adjudication Officer Janet Hughes also directed An Post to give him a compliant statement by 8 May 2023. The decision was dated 5 April 2023.

Smyth complained after being transferred from his Ballybay work base to the Monaghan delivery office. He said he had worked at the same location for 26 years and had no written statement covering his current post. An Post said it had agreed the office consolidation and relocation terms with the union, and that affected employees had been informed of the move.

Hughes found Smyth had not received a written statement compliant with the Terms of Employment (Information) Act. She found his separate complaint under the Pensions Act, which concerned the pension scheme and alleged age discrimination, was not well founded. The decision records that he could make additional pension contributions and that the total pension benefit did not differ because of the scheme’s structure.
