The Workplace Relations Commission found Slawomir Tompalski’s disability discrimination complaints against T O'Higgins Homevalue Hardware were not well founded in a decision dated 24 February 2022.

Tompalski said he was refused entry to the Galway shop because he was not wearing a face covering, despite saying he was exempt and objecting to a request for medical proof. The business said staff offered to bring goods outside and that customers could arrange collection.

The adjudication officer found Tompalski had provided no medical evidence to support the disputed disability claim. The officer also found that his request on the day concerned an exemption under the statutory instrument, rather than reasonable accommodation under the Equal Status Act.
