The Workplace Relations Commission dismissed Krzysztof Rawski’s unfair dismissal and race or nationality discrimination claims against J J Kavanagh & Sons Ltd. It dated its decision 7 December 2022. Rawski said his dismissal was connected to his Polish origin and that he was treated less favourably than Irish colleagues. The company said the dismissal followed misconduct and a fair process, and denied that nationality played a part. The WRC said nationality was the only ground advanced in support of the unfair dismissal claim and that it was unproven. It also found that Rawski’s behaviour contributed significantly to his dismissal. Both claims failed. The minimum notice complaint and the discriminatory dismissal complaint were withdrawn.
