WRC finds Marija Leontjeva entitled to redundancy payment

The Workplace Relations Commission upheld Marija Leontjeva's redundancy payment complaint against Ballyleague Mushrooms Limited, finding her entitled to a statutory payment. A duplicate complaint, CA-00038813-001, was withdrawn. Adjudication Officer Emer O'Shea dated the decision 1 February 2022. The payment was based on Leontjeva's employment from 11 May 2009 to 14 February 2020 and gross weekly pay of €420. The company argued that Leontjeva had rejected alternative work and a later offer to return to her original position. The officer found the January offers at other farms unreasonable given their distance from Ballyleague, and the offer to resume work there was made outside the statutory four-week time limit.
