WRC awards Anne Mullarkey four weeks’ gross pay over transfer complaints

By Donal Gilhooly

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found three complaints by Anne Mullarkey about the transfer of her work well founded and directed Horan Eco Services Limited to pay four weeks’ gross pay. The decision was dated 17 December 2021. A separate fixed-term complaint failed because Mullarkey was not a fixed-term worker and lacked standing to bring it. Mullarkey was a cleaner at Ballyhaunis Community School. The WRC found the school’s letter and its engagement with her fell short of the requirements to advise and consult her about the transfer and notify Horan of her terms and conditions. The award comprised one week’s gross pay for the terms and conditions complaint, two weeks for the consultation complaint and one week for the advice complaint.
