In 1999, the Labour Court upheld Avonmore Waterford Group’s appeal and overturned a Rights Commissioner’s recommendation for redeployment allowances to two workers. The Court said it did not support the recommendation after considering the parties’ submissions. The workers were made redundant after the company closed its Dungarvan plant, then secured temporary jobs at the Provender Mill.
Amalgamated Transport And General Workers' Union said the workers qualified for payments under existing agreements. Avonmore Waterford Group argued they had taken the jobs voluntarily and said they had received an orderly closure payment of £2,500, alongside other benefits. The Labour Court heard the appeal in Waterford on 23 September and signed its decision on 18 October 1999.
