The Labour Court found Fergal Mcgrath was unfairly dismissed by Kashan Carpets Trading As Lynfrae Trading Company Limited and set compensation at €8,800. The decision, dated 6 January 2026, varied an earlier €18,000 award after the employer appealed.
The employer cited sales performance, damage to a company van and credit card transactions. McGrath disputed misuse of the card and said he had no chance to answer the concerns before being dismissed. The Court found no procedures had been followed and he had not been given an opportunity to respond. It reduced the €40,000 financial loss it identified by 30% for mitigation and a further 48% for McGrath’s contribution to the dismissal.
