The Labour Court awarded Gary Rooney €201,458 compensation after finding that X Internet Unlimited Company unfairly dismissed him. In a decision signed on 15 April 2026, the Court varied an earlier award of €550,131.

The dispute arose after the company required staff to indicate within 46 hours that they wished to remain employed. Rooney did not respond, and the company treated his silence as resignation. The Court found there was no basis to do so, and that staff lacked enough information to make an informed choice. The company argued Rooney had chosen not to opt in and had not been dismissed.

The Court found Rooney did not contribute to his dismissal and had made reasonable efforts to find new work. It excluded his discretionary bonus and restricted stock units from the compensation calculation. The award included past and prospective losses.
