The Workplace Relations Commission found that Earthmoving Wear Parts Limited subjected Tomasz Pieronczyk to race-related harassment and ordered €6,000 compensation. It also ordered the company to pay €8,215 in gross wages after finding an equal-pay breach. The WRC decision was dated 16 April 2026.
The harassment finding concerned an online exchange with a work colleague about concrete blocks. The colleague wrote that they would not sell to Roma Gypsie. The WRC found the exchange was sufficiently connected to work to amount to harassment related to race. On equal pay, it found that a warehouse comparator performed equal work and that the employer had not justified the difference in pay.
The WRC also ordered €1,947.18 compensation because the company had not provided Pieronczyk with written employment terms on time. It found no constructive dismissal and rejected his claims of race discrimination in treatment, promotion, training and conditions, and victimisation. Pieronczyk said he raised concerns verbally; the company denied receiving complaints.
