Labour Court upholds decision against Dangan Group worker

The Labour Court upheld an Adjudication Officer’s decision against Gheorghe Daniel Marcu, finding that he had not shown a change to his employment terms after transferring to Dangan Group. The determination was signed on 15 February 2023. Marcu appealed after claiming that his terms and conditions changed following the transfer. He said he was told he would have to move to night shift after declining a task. Dangan Group said the task was on the previous employer’s task list and that night work was offered as an alternative. The Court said Marcu had not identified a change to any contractual right or obligation arising from the transfer. His appeal failed, and the original decision was upheld.
