Labour Court refuses late appeal by Shane Mccaul over employment information claim

The Labour Court refused Shane Mccaul’s request to extend the deadline for appealing a finding on his employment information complaint against Belfry Hospitality Services Ltd t/a Tougher’s Restaurant. The decision was dated 25 April 2024. The Court received his appeal one day after the 42-day deadline. McCaul said he had submitted it 85 minutes late and asked the Court to consider his health and other circumstances. The employer opposed an extension, citing the lack of exceptional circumstances and possible prejudice from delay. The Court found that exceptional circumstances had not been established and had no jurisdiction to hear the substantive appeal. The merits were not decided.
