Labour Court declines Andrzej Karkus’s late appeal against The Q Café Company Limited

The Labour Court declined jurisdiction to hear Andrzej Karkus’s appeal against The Q Café Company Limited after it was filed outside the 42-day limit. In a decision dated 2 February 2024, the Court said his explanation did not justify extending the deadline, so the Adjudication Officer’s decision stands; the merits were not decided. Karkus appealed a decision on his complaint under the Terms of Employment (Information) Act 1994. The latest date for the Court to receive his appeal was 14 November 2023, but it arrived on 20 November. Karkus said he had delayed sending it and realised he was late as time ran out. The company’s representative argued that this did not demonstrate exceptional circumstances.
