The Workplace Relations Commission dismissed Sergio Perez Zuriaga’s complaints against Sap Ireland Limited, finding that historic allegations about recruitment were out of time and later allegations did not meet the threshold for a discrimination or victimisation case. The decision was dated 6 February 2024. Perez Zuriaga alleged age and race discrimination and victimisation in a series of unsuccessful job applications. The company argued that older events were out of time and that the later claims did not establish a prima facie case, meaning enough evidence to require an answer from the company. The adjudicator found the events from 2013 through 2020 were separate and unconnected, and that the later allegations did not show a causal link between the unsuccessful applications and age or race, or facts supporting victimisation.
