The Labour Court upheld the Adjudication Officer’s decisions and dismissed Wiktor Glogiewicz’s appeals on 9 November 2018. The earlier decisions included a technical breach because DFS Trading Limited’s contract omitted its Irish address; the Adjudication Officer ordered the company to provide that address to employees in Ireland, without compensation.
Glogiewicz argued that his written employment terms did not comply with the Terms of Employment (Information) Act. DFS denied breaching the Act and said its contract and appointment letter complied. The Labour Court said written particulars could be set out in those documents and that it could not uphold unspecified claims.
