The Labour Court rejected Wiktor Glogiewicz’s appeal against the dismissal of his national minimum wage claim against DFS Trading Limited. Its determination, dated 9 November 2018, affirmed the Adjudication Officer’s decision to dismiss the claim as frivolous and vexatious under section 42 of the Workplace Relations Act 2015. Glogiewicz argued that different taxable components of his pay meant his claim should be considered on its merits. DFS Trading Limited said his basic annual salary was €25,419.68 for a 44-hour working week, with overtime paid for additional hours. After examining the parties’ submissions, work records and payslips, the Court found no valid grounds to send the case back for further adjudication.
