The Labour Court upheld the refusal of Declan Mcaleer’s statutory redundancy claim, finding that his employment had not ended when a new operator took over the business premises. The decision was signed on 7 March 2025. McAleer sought redundancy pay after his former employer, AJPC Retail Ltd trading as Costcutter, ceased operating. The Court found the new operator took over the lease and continued the same core forecourt, shop and deli business. It concluded McAleer remained employed when the lease transferred and continued in the same job, so no redundancy payment was due.
