WRC finds logistics driver’s dismissal unfair over flawed stock investigation

The Workplace Relations Commission found Joseph Foster was unfairly dismissed by Stl Logistics Ltd trading as Stl Logistics and awarded him €4,500. It also upheld his separate claim for four weeks’ notice pay, awarding €2,324. The decision was dated 10 March 2025.

The company said it dismissed Foster for alleged gross misconduct after a client reported missing kegs and an allegation was made that he had offered kegs for cash. Foster denied wrongdoing and disputed the evidence. The WRC did not decide whether the alleged misconduct occurred; it assessed whether the dismissal process was fair.

The WRC found the investigation did not properly disclose a key allegation or give Foster a fair chance to present his defence. It also found the CCTV had gaps, lacked a timestamp and did not show the whole truck bed, making it unreasonable to rely on it to establish how many kegs were delivered. The appeal officer failed to seriously consider Foster’s concerns.
