Labour Court upholds decision rejecting Emma Martin’s redundancy claim against Costcutter

The Labour Court upheld the decision rejecting Emma Martin’s statutory redundancy claim against AJPC Retail Limited T/A Costcutter, now in liquidation. The decision was signed on 7 March 2025. Martin said her employment with the former operator ended in January 2023 and sought statutory redundancy pay. The company argued that her employment had not ended when another operator took over the lease. The Court found Martin remained employed when the lease was reassigned to the new operator, which ran the same core business. It concluded her employment had not ended by reason of redundancy, so the respondent was not liable to pay statutory redundancy.
