Labour Court upholds decision rejecting Cecilia Fox’s redundancy claim against Costcutter

The Labour Court upheld the decision rejecting Cecilia Fox’s statutory redundancy claim against AJPC Retail Ltd T/A Costcutter, now in liquidation. The Court’s decision was signed on 7 March 2025. Fox said her employment with the former operator ended in January 2023 when it stopped trading at the forecourt, shop and deli. The company’s liquidator argued that her employment continued after another operator took over the lease. The Court found Fox remained employed when the lease transferred and continued in the same job with the new operator. It concluded her employment had not ended by reason of redundancy, so the respondent was not liable to pay statutory redundancy.
