Labour Court upholds Flynn redundancy pay decision after late appeal

The Labour Court upheld a decision that Rachael Flynn was entitled to statutory redundancy pay after finding her employer’s appeal out of time. The determination was dated 10 February 2025. Coras Mini Market Limited argued that communication problems and a lack of knowledge about the appeal form explained the delay. Flynn disputed that exceptional circumstances prevented a timely appeal. The Court found the employer’s initial submission invalid because it omitted Flynn’s contact details, and it found no exceptional circumstances to extend the deadline. It therefore could not hear the substantive appeal and upheld the adjudication officer’s decision.
