The Labour Court refused Kajetan Soltys an extension to appeal a redundancy decision, finding that his appeal was out of time and that it had no jurisdiction to hear it. The merits of the appeal were not decided. The original WRC decision found the redundancy complaint well founded and calculated the payment using a start date of 1 January 2015, an end date of 23 August 2021 and gross weekly pay of €429. Soltys appealed, saying new information showed his employment had begun on 5 August 2013. Soltys argued exceptional circumstances justified accepting the late appeal. The court noted he knew before the 42-day deadline that he needed to appeal and could have done so, but gave no explanation for filing nine days late. The determination was dated 18 April 2023 and signed on behalf of the Labour Court by Deputy Chairman Louise O'Donnell.
