The Labour Court upheld the rejection of Arturas Kononovas’s Payment of Wages complaint against The Gresham Hotel. It found he had not established that any unlawful deduction occurred. The decision was dated 27 November 2023.

Kononovas, a former sous chef, said the hotel’s time system recorded 542 hours in lieu when he resigned in June 2022, and he sought compensation for those hours. The hotel said a system error had inflated the balance and that it had paid him for all hours worked. It said it would not seek to recover a 10-hour overpayment.

The Court considered alleged contraventions from 26 April to 2 June 2022, the period between the start of the complaint’s cognisable window and the end of Kononovas’s employment. His representative could not identify a contravention during that period or during his employment. The Court found no evidence that he received less than the wages properly payable to him.
