Ana Oliveira awarded €400 over daily rest breach

The Workplace Relations Commission awarded Ana Oliveira €400 after finding that B. Gallagher Ltd trading as the Station House Hotel breached her right to daily rest on one occasion. In a decision dated 28 November 2023, the WRC found that seven of eight late-to-early shift changes were exempt because they arose from unforeseen circumstances. The remaining change, on 11–12 May 2022, had been rostered in advance and was not exempt. The hotel said staff illness, bereavement and other unforeseen absences prompted the changes, and that Oliveira received compensatory rest after each occasion. The adjudicator said the €400 award took account of the staffing circumstances and Oliveira’s short service, while aiming to deter future breaches.
