The Labour Court partly upheld Colman Curran’s appeal against Magna International Autolaunch Ireland Limited and directed the company to pay him €95.60 compensation. In a determination dated 27 November 2023, the Court found that one day’s injury pay had been unlawfully withheld. Curran said past practice entitled him to full pay after he was injured in a workplace assault. The company relied on its sick pay and workplace injury policies. The Court found that a policy introduced in 2020 replaced the earlier practice, which did not create a contractual right to full pay. It also found Curran was entitled to three weeks’ sick pay and six days’ payment under the injury policy. He received the sick pay due, but was paid for only five of the six injury-pay days. The appeal was partly successful.
